BIKER NEWS -- WACO (December 1, 2015) Another biker who was among nine named in sealed indictments in November stemming from the deadly May 17 shootings at the Waco Twin Peaks restaurant was in the McLennan County Jail on Tuesday morning.

James Madison Caffey, 39, was ordered held in lieu of $250,000 bond charged with engaging in organized criminal activity, online jail records showed.

It was not clear Tuesday morning if Caffey was the last of the nine named in sealed indictments to be arrested or whether one suspect remained at large.

Jail records showed Caffey was taken to the jail by the McLennan County Sheriff’s transportation officer from Upshur County, where Caffey had been in custody after his arrest on a warrant issued following the indictment, a jail records clerk said.

The sheriff’s office last week reported eight of the nine named in sealed indictments had been arrested and one was at large, Sheriff Parnell McNamara said.

Details of Caffey’s arrest were not known Tuesday morning.

Cory McAlister, 36, of Ore City; Paul Russell Miller, 39, of Gholson; Ray Asbary Nelson, 42, of Waco; Clifford Pearce, 52, of Waco; Jerry Edward Pierson, 49, of Dallas, and Jeffrey Veillon, 53, of Wylie, turned themselves in in mid-November and were later released on bond.

Two others were arrested later, but their names weren’t immediately released.

The nine indictments were sealed because those defendants were not among the 177 bikers arrested on the day of the shooting and they remained at large, McLennan County District Attorney Abel Reyna said.

The 106 indictments all charge engaging in organized criminal activity with the underlying offense being aggravated assault or murder, making the charge is a first- degree felony, punishable by a prison term of from 15 to 99 years or life in state prison and/or a fine not to exceed $10,000.

In part, each of the 106 indictments says that the named defendant did "intentionally and knowingly cause the death of an individual …"

"And the defendant did then and there commit the offense as a member of a criminal street gang."

Most of the first 106 bikers indicted in connection with the deadly May 17 shootout at Waco's Twin Peaks restaurant are members of either the Bandidos or Cossacks biker gangs or of clubs closely affiliated with one of the two rival gangs, a review of the indictments shows.

Both the Bandidos and the Cossacks, are named as "criminal gangs" by the U.S. Department of Justice, and the Texas Department of Public Safety classifies the Bandidos as a street gang.

Authorities have said an ongoing feud between the two gangs led to the shootout between bikers and police that left nine bikers dead and 20 more injured.

It was not clear when the remaining 80 suspects might be presented to grand jury for consideration, but it's apparent from the review of the cases that most are likely members of clubs that aren't closely tied to either of the two gangs.

Once the individual cases begin to make their way into courtrooms for final resolution, it could take months to get all of the cases off court dockets.

Prosecutors say they'll seek plea agreements in at least some of the cases but that most may end up going to trial.
